Roundtable in Istanbul Provides Insight on the Calculation of Damages in Lawsuits

Member firm Moroglu Arseven hosted a roundtable discussion on the Calculation of Damages in Lawsuits Arising from Infringement of Industrial Property Rights, in collaboration with INTA.

The event, held in Istanbul, Türkiye, was moderated by Yonca Çelebi (Moroglu Arseven, Türkiye), and featured presentations by Prof. Dr. Sevilay Uzunallı (Izmir University of Economics, Türkiye) and İlhami Güneş, a retired judge of the Izmir Intellectual and Industrial Property Rights Court.

Ms. Uzunallı discussed Turkish and European legislation regarding the methodology of the calculation of claims for damages arising from trademark infringement, emphasizing that compensation should act as a deterrent, but it should not exceed the actual damages incurred, nor should it enrich the trademark holder.

Mr. Güneş explained the types of damages that the trademark owner can claim and shed light on the discretion of the judge, which is of great importance in the issue of damages, based on both his own experience as a retired judge and different judicial decisions.

During a Q&A, participants contributed to lively discussions on compensation claims at different exchange rates, the calculation of interest, and the role of experts in the proceedings.
