Over the past five years, the Canadian Trademarks Opposition Board (TMOB) has significantly transformed its operations to resolve trademark disputes more efficiently. TMOB proceedings are now almost entirely virtual, a significant backlog of cases has been eliminated, and timelines for various steps in TMOB proceedings have been tightened. Further changes are coming: the TMOB has been granted additional authorities, including the power to issue confidentiality orders and award costs. Join us as the TMOB shares with INTA members the many improvements to its services and offers suggestions for best practices for trademark practitioners to benefit from these improvements.

DBI’s help brand owners resolve online issues by allowing the blocking of websites, IP addresses, or domains involved in infringement, even if not specifically identified when the order is issued. Our panel will explore how courts are implementing DBIs to combat online trademark infringements—including legal frameworks and case studies——to provide a comprehensive understanding of the global DBI landscape and the implications for the future of trademark law.

Should Geographical Indications (GIs) have protection commensurate with trademarks in the Domain Name System (DNS)? Recent European Union legislation, extending the protection of GIs to use within the DNS, and the upcoming ICANN Uniform Dispute Resolution Policy (UDRP) Review have created urgency around the issue. Many in the GI and brand communities argue that a framework is necessary to ensure consistency in protection and to safeguard legitimate user and consumer interests. How will governments, brands, and the domain industry manage this issue? Our panelists will discuss the goals, challenges, and possible solutions when balancing GI and trademark protection in the DNS.

Legal and Policy | Avoiding the Accidental Franchise and Other Licensing Pitfalls

Every franchise agreement contains a trademark license, but not every trademark license necessarily qualifies as a franchise agreement. Franchising is heavily regulated in the United States at the federal level and on the state level by various state regulatory agencies. Trademark licensors must carefully structure their license agreements and relationships with their licensees to avoid inadvertently becoming franchisors in the eyes of the courts, regulators, and their licensees. This session provides a primer on the franchising laws in different jurisdictions and their application to unwary trademark licensors.

Legal and Policy | A Historic WIPO Treaty Involving Indigenous Rights: Its Impact on the Future of IP Rights

Presented by the 2024–2025 Indigenous Rights Committee

The WIPO Treaty on Intellectual Property, Genetic Resources, and Traditional Knowledge was ratified in May 2024. Our panel will explore the Treaty’s implications for the future of intellectual property rights; provide an overview of Indigenous Rights, Traditional Knowledge, and Traditional Cultural Expressions; and share relevant background on the 25 years of negotiations that resulted in the Treaty’s adoption. The panel will also explore issues relating to the adoption of the Treaty, developments in connection with WIPO’s Intergovernmental Committee meetings (upcoming in November/December 2024), and how ratification of the Treaty may shift the global dialogue and national treatment of Indigenous Rights and Indigenous Peoples, including how key regions have already responded.
