Which Rights for Which Data? A Legal Take on the Big Data Landscape
Data is everywhere, from machine-generated data sources from personal devices, phones, and wearables to data volunteered by consumers through customer service communications.
Join us for this session focused on both the U.S. and international environments, as our panelists tackle these questions:
- What are the legal rights that attach to these different data sets, and who owns those rights?
- How can businesses protect the valuable data they are gathering and leveraging—through copyright law, contract law, anti-hacking law, trade secrets, data rights, or even unfair competition law?
- Are these rights sufficient to protect a business’s assets and activities? Are there other forms of protection to consider, technical for instance?
Moderator:
- Ainslee Schreiber, VP, Legal, Global Head of IP, Privacy, and Product Development, WeWork (USA)
Speakers:
- Otavio Padilha, Partner, Soerensen Garcia (Brazil)

Managing Data Subjects’ Rights in the Context of Immersive Technologies
There are many challenges raised by exercising and enforcing individuals’ rights when data is collected through smart devices, virtual reality games, the metaverse, etc. While the goal is to provide the ultimate user experience, it can be complex for controllers to comply with notice or consent requirements to harness and process this data in the context of brand protection, among other things.
This session will focus on the interplay between intellectual property and data privacy, as well as on the many innovative ways to:
- Ensure compliance, both from the perspectives of the data subjects and the service providers, including real-life examples.
- Understand third-party services, such as data fiduciaries, and the extent to which they can be part of the solution to compliance issues.
Moderator:
- Francesca Silverman, Vice President and Senior Managing Counsel, Intellectual Property, Mastercard (United States)
Speakers:
- Flavia Mitri, Privacy & Cybersecurity Legal Director, Uber (USA)
- Leann M. Pinto, President, IPwe (USA)

Navigating E-commerce in 2023 (Part II)
In 2022, the implementation of U.S. state data protection laws, such as the California Consumer Privacy Act, and decisions in cases such as The People of the State of California v. Sephora USA, Inc., where fines were imposed against brand owners, sent ripple effects in the brand and AdTech world. This session will feature a discussion on the expected changes in the U.S. and globally in 2023 as we move forward in the world of consumer protection and OPT OUT requirements, and the effects of these changes on e-platforms that rely on real-time data for targeted advertising purposes. What do brand owners need to know and do in this new environment?
