Regional Training Seminar for Central American Customs Officials
(Exclusive to in-house practitioners only; advance registration required)
INTA’s Anticounterfeiting Committee is organizing a training seminar for customs officials in Central America.
This event will help brand owners advocate for stronger anticounterfeiting measures in the region and provide a platform for members to better educate these officials about their brands. Distinguished speakers from Customs offices from seven Central American countries and Mexico, United Nations Office of Drugs and Crime and the U.S. Patent and Trademark Office are invited to discuss local customs practices and international best practices.
The event is open to all INTA corporate members attending the Leadership Meeting. The event will give time to the brand owners to give their brand-specific identification training to the officials, so that these officials can share the brand owners’ insight on how to distinguish genuine and counterfeit goods at their borders. Representatives from Chanel, Procter and Gamble, and Richemont have already confirmed their participation in the event.

Join us as Etienne Sanz de Acedo, CEO of INTA, presents the State of the Association Address and as INTA President J. Scott Evans sums up his presidential year and presents the President’s Award and Volunteer Service Awards. The President’s Award recognizes exceptional INTA participants who, over the course of a career in trademark law, have made an outstanding contribution to the law and to the advancement of the Association. The Volunteer Service Awards are given to individuals who have provided exemplary volunteer service to INTA during the past year in the advancement of trademark law, committee objectives, pro bono services and the Association.
We are pleased to welcome both Alvaro Aleman, Ministry of the Presidency and Jorge Luis Quijano, Administrator of Panama Canal Authority. Mr. Aleman will welcome registrants and highlight the many important reasons why Panama City has been chosen as the location for the Leadership Meeting and Mr. Quijano will give registrants more insight into the importance of the Panama Canal on the impact the expansion has on brand owners.

The Impact of the Expansion of the Panama Canal on Trade and Brands
The Panama Canal expansion project, expected to conclude in early 2016, will double the capacity of the canal and potentially increase the risk of trade of counterfeit goods globally. Registrants will have the opportunity to learn more about the expansion of the Panama Canal and speakers will discuss the possible effects on their business, as well as doing business in Latin America. The UNODC and the WCO launched the Container Control Programme (CCP) to assist governments in establishing effective container selections and controls to prevent drug trafficking, transportation of counterfeits and other illicit cross-border activities. At the heart of this innovative approach is the creation of interagency Port Control Units (PCUs), consisting of risk analysts and physical inspection teams from different law enforcement agencies (e.g., Customs, Police and other law enforcement agencies) who are trained and equipped in the framework of the CCP to work together to systematically target high-risk containers for professional law enforcement scrutiny, using risk analysis and other proactive techniques with minimum disruption to the free flow of legitimate trade. Speakers will also share insights into issues such as logistics, customs and border enforcement.

Free Trade Zones
A free trade zone (FTZ) is a specified area within the territorial jurisdiction of a country where there is either a minimum of or no customs control on entry or exit of goods. FTZs are not subject to such standard government restrictions on trade as customs treatment, banking laws, taxation, labor laws and economic laws and transactions. This panel will explore the ways counterfeiters use FTZs to disguise the true country of origin of goods through transshipment or manufacture of counterfeit goods. It will also explore ways that brand owners, national customs officials and the FTZ authorities can work together to enforce trademark rights in FTZs.

(App)ealing to a Wired Audience: Trademarks and Mobile Advertising
Speakers will look deeper into the disparity between the traditional brick and mortar “games” and their changed avatars in the app space to understand the trademark challenges associated with such transitions. From protection to enforcement, while app owners face multi-jurisdictional trademark challenges, the platforms have their own dilemmas in dealing with rights conflicts. Some of the issues speakers will consider are:
- Trademark policies for the various app stores and how they impact brand owners.
- Translating the brick and mortar games and toys into the app space.
- Protection i.e. branding challenges in apps.
- Enforcement challenges and determining infringement and passing off issues in apps.
- Best practices for clearance searching and enforcing.

Free Trade Agreements and Latin America: What’s in Store for Intellectual Property in the Region
The past several years have seen an unprecedented cooperation in trade and investment between Latin America and the exterior, as well as within the region itself. Through the rapid development of economic integration initiatives, such as the Pacific Alliance, the Transpacific Partnership (TPP), the Asian Pacific Economic Cooperation (APEC), and the rising number of FTAs with Asia, Europe and the United States, Latin America has benefited from an increasing number of investment opportunities and an exponential growth in innovation. Consequently, what does this mean for the future of intellectual property in Latin America?
This panel will provide registrants with the chance to hear from the directors of some of the most advanced IP offices in Latin America as they discuss the impact of these economic integration initiatives on intellectual property in their jurisdictions, as well as the role the offices are playing in developing the IP policy under these various initiatives.

This session will focus on leading through change and how to excel in fluid environments, whether on the practice field, in the office or while volunteering at INTA.
Gary Stempel, former Head Coach and Manager of the Panamanian national football team, and current Head Coach and Manager of San Francisco FC, based in La Chorrera, Panama, will kick off the program with a unique perspective stemming from his leadership roles across several Central American football teams and from his intriguing and inspiring story of leadership and mentoring.
Immediately following will be an All-Star panel featuring past, present and future INTA leaders, who each will give their perspective on navigating the waters of change across business, dynamic organizations of various shapes and sizes, and INTA itself.
These experienced and diverse professionals will share their tips, war stories and lessons learned, engaging all attendees on how to achieve goals, be an effective leader and create strong and energetic teams during times of transition.

The Business of Fashion — Brand Protection: Always and in All Ways
In today’s omnichannel, global and technology-fueled market, fashion and apparel companies must use more than their trademarks to protect their brand. Industry insiders and the outside counsel who advise them will discuss how the fashion industry uses a multidisciplinary approach, including trade dress rights, design rights and copyrights, to safeguard their brands, designs and reputations. The panelists will discuss important differences in the IP laws of Europe, the United States and Latin America and how those impact the fashion and apparel industries. They will also explore the importance of brand protection at all stages of design, from inception, to production, to licensing and sale. Beyond the sale, communicating to the consumer about brand protection is just as important as protecting the brand itself. With social media making the connection between fashion house and consumer closer than ever, brand owners must consider how best to communicate their brand protection message. The panelists will share best practices and guidelines for these communications.

Trademarks Enforcement at Customs: A Comparative Analysis in the Latin and Central America Region
Counterfeit goods are manufactured and distributed every day around the world, making the involvement of the customs authorities in specific regions and worldwide of utmost importance as the “first line of defenders” in combatting this illegal phenomenon and disrupting the supply chain of fake items.
Speakers will discuss the importance of providing a suitable legal frame to enforce IP rights at the point of entry of the majority of counterfeit goods and will cover the following points:
- Provide information concerning the available legal means; legal powers and involvement of customs authorities in enforcing trademark rights per jurisdiction.
- Disclose information on how each system works, including timeframes.
- Discuss transshipments and how the relevant countries are dealing with them.
- Share intel on how counterfeits are being trafficked in the Latin and Central America region; including examples of possible routes of counterfeits coming from Asia.

The Challenges of a Global Advertising Strategy Within Regulated Markets
There is a global trend to regulate the way in which companies interact with their consumers, how they may provide information and advertise their products. Of the many affected industries are the food, pharmaceutical, beverages and tobacco industries. With this new trend, issues like plain packaging, new labeling requirements and advertising restrictions generate a series of challenges for trademark owners in connection to the use of their trademarks and the way they may market their products. Moreover, new regulations, in some cases, can even be deemed expropriatory of IP rights. Speakers from different industries that are impacted will analyze some of the issues that arise from this new regulatory environment, the impact that they have and the strategies being adopted by some to adapt to these new global challenges.

Intellectual Property and the Judiciary: The Latin American Perspective
The judiciary plays an important role in protecting intellectual property rights in Latin America. However, a disparity exists in the level of understanding of intellectual property matters among justices throughout the region. At the same time, there is an increasing number of trademark related disputes that are brought to court, so it is critical that the Judiciary closely examines the cases in order to be able to issue fair and sound decisions.
This session brings together justices from the Supreme Courts of Paraguay, Panama and the Andean to discuss the challenges they face within their respective jurisdictions, as well as the different IP-focused initiatives and developments taking place throughout their judicial systems.
