IP and Innovation | TM5 and INTA Seventh Joint Workshop: Proving Use of Trademarks in TM5 Offices
A trademark refers to a mark used by an enterprise to distinguish its goods and services from those of others. Proving the use of a trademark is an important point during the phases of examination, trial, and litigation from standpoints including that of maintaining trademark rights. However, the cases and procedures for granting proof of trademark use differ by country, as well as by region. This workshop will feature presentations from the TM5, comprised of the five largest IP offices in the world, and will include valuable information for users regarding proof of trademark use.
*TM5 is a forum through which the China National Intellectual Property Administration, PRC (CNIPA), European Union Intellectual Property Office (EUIPO), the Japan Patent Office (JPO), the Korean Intellectual Property Office (KIPO), and the United States Patent and Trademark Office (USPTO) exchange information and undertake cooperative activities with the aim to support global business activities through trademark protection.
IP and Innovation | Co-Chairs Overview of the Day
IP and Innovation | Global Routes of Counterfeits
A recent report published by the Organisation for Economic Co-operation and Development (OECD), namely “Global Trade in Fakes—A Worrying Threat,” estimates that the volume of international trade in counterfeit and pirated products amounts to as much as US $464 billion in 2019, or 2.5 percent of world trade. Counterfeiters continue to exploit complex trading routes, and counterfeit products are shipped by various means of transport, from small parcels to big containers. It is also apparent that counterfeiters tend to use multiple assembly points to produce counterfeit goods, and these assembly points are usually dispersed across several countries. Furthermore, the COVID-19 pandemic has increased the trade of counterfeit products to the online space, while the macroeconomic and macro-political factors further complicate cross-border investigation and enforcement actions. Therefore, authorities, brand owners, and intermediaries across regions need to work hand in hand to tackle the counterfeiting issue from a global lens. In this session, hear from authorities, brand owners, and intermediaries to share their insights and best practices in fighting against the global trade of counterfeit products.

IP and Innovation | Online Reviews: A Boon or Bane for Business in the Digital Age?
Product reviews have been around forever, but new players, technologies and online business models mean it’s anything but business as usual. More and more consumers seek out online reviews, ratings and comparisons before making a purchase, so the appeal for brands to incentivize reviews and direct marketing dollars towards affiliated ranking/review sites and influencers is obvious. Yet there are traps for the unwary, as regulators across the globe have made it a priority to address the problem of “fake” reviews and similar deceptive practices that ultimately harm consumers. This session will discuss how to effectively harness the power of legitimate online reviews and rankings while avoiding pitfalls that can cause major problems — including deceptive “pay-to-play” reviewers, insufficient disclosure of incentives or material connections, and improper filtering out of negative consumer reviews. This session will also discuss what steps a brand can take when a competitor is improperly leveraging comparative reviews or rankings.

IP and Innovation | How Blockchain and Smart Contracts are Disrupting Our IP Business
Imagine a world where IP is protected and managed in a completely different way, where creators can easily and securely monetize their work, and where contracts allow creators to automate licensing. They can set license terms and receive payment automatically when their IP is used, without the need for intermediaries. Furthermore, blockchain can be used to create decentralized IP systems in which assets are managed and licensed directly by the rights holders. This will change the IP landscape and give right holders more control over use and distribution. The use of blockchain and smart contracts in the IP space is still in its early stages, but these technologies will significantly evolve IP management landscape. They are already in use for copyright registration, domain name registers, artwork provenance, and patent pools. Join us for this session, as we explore emerging opportunities, pitfalls, and the skills needed to offer these new services:
- Valuation, sales, and micro-licensing world-wide to earn money with IP
- Fractional ownership of IP for raising capital
- Infringement protection using patent pools & micro-licensing
- Automated worldwide monitoring for trademark use, infringement, and counterfeiting
- Automatic generation of evidence and prior art
- Automatic escrow—simultaneous payment and transfer of ownership

Protecting Your Intellectual Property Rights—Managing and Monetizing Intellectual Property Disputes
Companies invest significant capital in developing and protecting intellectual property. However, pursuing action against infringers of those intellectual property rights can often be complex and costly – often involving technical legal analysis, having to take action across multiple jurisdictions, and ultimately enforcing a judgment/award. The risks are particularly acute in today’s climate, with geopolitical tensions contributing to the increasing complexity in pursuing and enforcing such claims.
This session will focus on strategies that companies can adopt in managing the risks and costs associated with protecting intellectual property rights, including:
- Early stage (pre dispute) considerations;
- Managing the costs and risks of ongoing intellectual property disputes; and
- Successfully enforcing against errant counterparties.

IP and Innovation | Persuasive Speaking: Making Your Words Matter
As legal professionals, the spoken word is vital to our working lives and careers. Most of us are skilled with words and trained in various forms of verbal communication. Nevertheless, our words sometimes may lack intentionality and focus. The task of communicating clearly and persuasively can be complicated by the specific circumstances giving rise to the need for effective communication. The most effective verbal communications should also take into account our goals for the communication, which may differ in various professional settings (e.g., in-house or a law firm, or whether working with colleagues, clients, prospective new hires or higher-ups).

Integrating Work and Life Workshop (pre-registration required)
Shifting the Scales: Creating Allies by Inviting a Balanced and Retainable Support Structure
Presented by The Women’s LeadershIP Initiative Project Team
Even though the pandemic has increased the chances of remote working, isolation has changed how women are supported in various careers. Whether networking, hiring, retaining, or maintaining a work and life integration, the support structure provided by both an individual and an organization continuously shifts the scales of balance. Whether you work from home or in the office, there is still a need for coping mechanisms for managing personal demands while on the job and vice versa.
Self-care and time management are the foundations of any support unit. Balancing work and life is not only seen amongst women but also men, as they take an active role in their partner’s lives or are themselves single units, looking for allies. Support can come in many forms, whether in relationships, companionship, with family members, or even hiring. What do they have in common? What are the work implications of being single or part of a family unit on the personal and wider socio-economy?
Whether socially, financially, or culturally: How do women manage their work and life without hindering their needs, and do their social and cultural sentiments remain kept?
In this session, members are invited to shift the scales and address challenges faced by both men and women in the pursuit of integrating work and life.
Topic highlights include:
- Digging deep to discover your own integration of work and life
- Using communication as an effective tool to balance the scale within your home and work ecosystems or both
- What are the practical tools, and who are the support mechanisms to help reach a work and life integration
- Learning about what other organizations are doing to shift the scales for their employees

IP and Innovation | Professors Panel: Of Parodies, Referential Use, and Other Creative Uses: Walking the Fine Line Between Limitations and Infringement
Discussions over the use of trademarks in public discourse are nothing new. Yet, uncertainty continues to dominate, in practice, on how to assess when such uses are lawful or, instead, constitute trademark infringement or dilution. When, in January 2023, Shakira accused her ex-husband of trading “a Ferrari for a Twingo” and “a Rolex for a Casio” in her instantly famous revenge song, trademark attorneys across the globe wondered, “Is such use a parody, referential use, descriptive use, or trademark dilution?” While no lawsuit seems to have been filed in that case, several prominent cases in this area are pending or have been decided across many jurisdictions. This panel of distinguished academics will address these cases and recent developments on the topic in Asia, the United States, and Europe.

IP and Innovation | Welcome to the Future: Emerging IP Issues Relating to AI and Its Impact on Brands
As our society continues to move on-line, technology is increasingly handling more and more of our day-to-day tasks both in business and as consumers. For example, artificial intelligence or “AI” can generate artwork, draft advertising copy, or review, rank, and recommend products or businesses to us based on its analysis of a vast amount of personal, business, and public data. This new frontier in IT has led to many questions for brands. During this session we will look at some of these emerging issues, including:
- How AI forms “opinions” and develops outputs, what happens if they are “programmed” to favor certain brands or confuse brands, whether they even care about brands or infringement, and how their outputs may impact brands, the infringement analysis, and liability
- Whether AI may be considered “consumers,” whether their confusion matters, and how their confusion may be analyzed
- Whether AI may be considered “influencers” and whether advertising regulations apply to their outputs and recommendations
- How brands may leverage the use of AI in the marketplace, but also protect their IP and brand, minimize risk, and address AI confusion and the confusion AI may create

IP and Innovation | Mediating Across Cultural Differences
In a world that’s more connected than ever—with brands spanning the globe—counsel for brand owners are routinely expected to represent their clients in multiple jurisdictions with different laws, languages, and cultures. Although they can learn the law, brand counsel may nevertheless have difficulty understanding cultural norms when mediating international disputes. However, lack of understanding of cultural differences can create unspoken barriers to successful dispute resolution.
The session will include a live-role-playing mediation during which our panel will play out several scenes that would typically occur in mediation. These scenes will demonstrate some top tips on how to conduct a successful mediation by avoiding cultural faux pas. The role playing mediation will be set in Singapore and will focus on Singapore’s singular cuisine.
