Fake Stores: The Growing Trend in Counterfeiting and How to Combat It

The Women’s LeadershIP Initiative Workshop―Advancing Women’s Leadership: Women and Men Working Together to Effect Change (Option 1)
This workshop is being offered three times. The workshops are not a series and each one will cover the same discussion topics.

While we have seen some improvement in recent years, the number of women in senior positions in our profession—even in the trademark field—remains low, promotion rates for women lag behind those for men, and pay gaps between men and women widen as they advance in their careers. Does everyone see the problem this way? And do we all agree on a solution?
A recent study asked men and women what the biggest challenges are to women’s career advancement. The number one reason identified by men was that there are too few qualified women in the pipeline, while the number one reason identified by women is that they are judged by different standards from men. While seven percent of men believe that women are less likely to be promoted to first-level manager roles, 19 percent of women believe that is the case.
This workshop, offered in the context of The Women’s LeadershIP Initiative, INTA’s new project to champion and advance women’s leadership in the IP field, will bring together women and men to discuss current realities and to learn ways to support each other as they communicate and collaborate more effectively.
Walk away with some fundamental building blocks to enable women and men to cooperate in eliminating the inequities of women’s representation in senior leadership roles including developing winning strategies for: 1) Sponsorship and Strategic Alliances; 2) Self-Advocacy; 3) Networking; and 4) Leadership and Executive Presence. Participants will leave this workshop, armed with feedback and inspiration, to develop the skill sets they need to improve the performance and success of women as well as men—and their organizations as a whole.

Town Hall: IP Practice of the Future—A View from Intellectual Property Offices (IPOs), In-House, and Law Firm Leaders (Option 1)
In 2019, INTA began a think tank initiative based upon the simple question: “What might the IP practice of the future look like?”
We formed three Think Tank Teams: IPOs, In-House Practitioners, and Law Firms, and asked each group to look at the current practice and predict the future. Each group prepared an independent, proactive, and thought-provoking report.
Join leaders who worked on one of the Think Tank teams as they share their findings—what surprised them and what they propose we do to prepare for the future—and uncover common trends across all three segments, while also highlighting divergent views based on technology adoption, resource management, and prioritization.
After the presentation of key findings from the reports, you will have a chance to ask questions of the panelists as well as other participants in the Think Tank project.

Design Law: Complementing Anticounterfeiting and Brand Protection Strategies

Design rights are increasingly important for brands looking to build a well-rounded and effective anti-counterfeiting/brand protection program. A common infringement tactic to avoid takedown or seizure is to remove references to a brand’s trademarks but continue to sell counterfeit or identical-looking goods, especially in connection with online sales. Consumers can be as confused by design-infringing “knockoffs” as by direct counterfeits. Design rights help to bridge the IP gap.

This workshop presents an opportunity for key stakeholders in the fight against counterfeiting to work together in a closed-door environment, sharing their perspectives, discussing lessons learned and best practices, and exploring ways to enhance collaboration and cooperation.
This year’s workshop will build on the successful events at past meetings by exploring some of the key themes to come out of those discussions.
Attendees will share examples of particularly helpful practices and processes that they are utilizing in the fight against online counterfeiting.
The workshop is exclusive to three key groups of stakeholders:
- Corporate in-house representatives—brand owners impacted by counterfeiting
- Intermediaries, including digital commerce service providers—in-house representatives from the digital commerce environment, which includes marketplaces, payment service providers, search engines, and social media platforms, as well as Internet registries, registrars, and logistics companies
- Government officials—government and law enforcement officials involved in the fight against online counterfeiting

Over the years, China has seen a staggering rise in trademark applications―from contributing 31 percent of the world’s filings in 2010 to over 70 percent in 2019. For the first half of 2020 alone, over 4.28 million trademark applications were filed in China. Despite the initiative and resolve of the Chinese government to crack down on bad-faith trademark applications and rampant IP infringement, these issues remain the most common problems―affecting brand owners of all sizes in every industry sector globally.
The Bad-Faith Workshop: From Defenses to Damages presents an important opportunity for us to share the latest developments in China’s judiciary and administrative authorities, and for you to walk away with valuable tips on identifying, implementing, and budgeting for your IP protection strategy. Bad-faith considerations are likely to tip the balance and will play a key role in pushing the boundaries of the Chinese IP legal system by persuading judges or examiners to apply the legal framework more flexibly.

On November 1, 2019, a revised version of the Trademark Law of the People’s Republic of China came into force. The amended Chinese Trademark Law includes a new provision requiring courts to penalize the bad-faith pirates who file with the intention of generating large compensation from brand owners. However, the scope of the financial burden that should be imposed on bad-faith pirates is hotly debated as is compensation for direct harm to brand owners. We will explore:
- Whether the legal and investigation costs incurred by victims in pursuing oppositions and invalidations should be compensable
- Whether the mere filing of bad-faith trademark applications represents a ‘civil act,’ and pursuit of tortious liability is an appropriate course of action
- Best practices from the procedural perspective, contrasting with courts in the United States or Europe that may invalidate marks in a counterclaim

Bringing Your Business Online in China
China is the world’s largest online retail market with online retail sales totaling close to US $ 1.33 trillion in 2018, which would account for 53 percent of all online global retail sales for that year. As online sales in China continue to grow at a rate of over 20 percent per year , creating and developing an online presence in China is essential for foreign brands if they are to have continued relevance and growth in the world’s second largest economy.
However, the Chinese e-commerce ecosystem and online environment is unique in many ways, and what might be a successful e-commerce strategy for Europe or North America will not necessarily (or will likely) not succeed in China. Ultimately, success in China’s online marketplace will hinge on a foreign company’s ability to develop and adopt a unique Chinese e-commerce branding strategy.

The number one reason identified by men was that there are too few qualified women in the pipeline, while the number one reason identified by women is that they are judged by different standards from men. While seven percent of men believe that women are less likely to be promoted to first-level manager roles, 19 percent of women believe that is the case.
This workshop, offered in the context of The Women’s LeadershIP Initiative, INTA’s new project to champion and advance women’s leadership in intellectual property, will bring together women and men to discuss current realities and to learn ways to support each other as they communicate and collaborate more effectively.
Walk away with some fundamental building blocks to enable women and men to cooperate in eliminating the inequities of women’s representation in senior leadership roles, including developing winning strategies for: 1) Sponsorship and Strategic Alliances; 2) Self-Advocacy; 3) Networking; and 4) Leadership and Executive Presence. 2020 Anticounterfeiting Workshop: Combating Online Counterfeiting Together (Option 2)

This workshop will be presented in two parts:
- 3:30 pm – 4:30 pm: Stakeholder meeting (1 hour)
- 4:45 pm–6:45 pm: Plenary session (2 hours)
This workshop presents an opportunity for key stakeholders in the fight against counterfeiting to work together in a closed-door environment, sharing their perspectives, discussing lessons learned and best practices, and exploring ways to enhance collaboration and cooperation.
This year’s workshop will build on the successful events at past meetings by exploring some of the key themes to come out of those discussions.
Attendees will share examples of particularly helpful practices and processes that they are utilizing in the fight against online counterfeiting.
The workshop is exclusive to three key groups of stakeholders:
- Corporate in-house representatives—brand owners impacted by counterfeiting
- Intermediaries, including digital commerce service providers—in-house representatives from the digital commerce environment, which includes marketplaces, payment service providers, search engines, and social media platforms, as well as Internet registries, registrars, and logistics companies
- Government officials—government and law enforcement officials involved in the fight against online counterfeiting
Please note that space is limited, and registration is therefore on a first-come, first-served basis. In view of space limitations, we ask that no more than two representatives of an entity or organization attend this workshop.

Intellectual Property Offices (IPOs) attending this workshop will have the opportunity to exchange insights—just among themselves—on the IPO of the future, in particular over the next 10 years.
The intellectual property (IP) world is changing at a rapid pace and in many ways, including: the rise in the value of intangibles; increased IP filing volume and volatility; the emergence of new countries as IP powerhouses; the internationalization of IP; the growing complexity and interdisciplinary nature of technologies; the changing nature of work and businesses with disruptive technologies; the deepening intersections among IP, trade, anti-trust, and innovation; the diversity of innovation emerging from developing countries; and the increasingly more central role of IP in fueling the innovation required to address the world’s most daunting challenges.
How can IPOs become and remain nimble and robust enough to absorb, manage, facilitate, and enable all this change? What might the IPOs of the future look like? What are the commonalities of their key interests and vision, acknowledging the different mandates, historical contexts, social imperatives, and economic opportunities specific to each IPO? What challenges and opportunities will the IPO of the future face, and how best can it respond to them?
Based on the “IPO of the Future Think Tank Report,” which reflects the collective input of 12 current and former Heads of IPOs, the discussion will focus on the following key themes of the report:
- The evolution of the IP system, and how the world has changed

Though the pandemic is the crisis that is fresh in our minds, brands can face many different kinds of crises—pandemics and natural disasters, data privacy breaches, public relations missteps, losing critical people unexpectedly, product recalls, and negative social media messages.
This workshop will start with first-person accounts of how to manage and navigate a brand crisis due to natural disasters, staffing, public relation problems, and other unexpected events.
Small group discussions will follow so that attendees can share their own experiences as together we identify solutions to help business teams reduce their risks from brand crises, and put plans in place to act nimbly and proactively to (hopefully) limit the impact of brand crises.
