A common infringement tactic to avoid takedown or seizure is to remove references to a brand’s trademarks but continue to sell counterfeit or identical-looking goods, especially in connection with online sales. Consumers can be as confused by design-infringing “knockoffs” as by direct counterfeits. Design rights help to bridge the IP gap.
